These Terms of Service (“Terms”) constitute a legally binding agreement between you and 1STAY TECHNOLOGY PRIVATE LIMITED (“1stay.in”, “Company”, “we”, “us”, or “our”) regarding your use of our website, mobile application, and related services (collectively, the “Platform”).
By creating an account or using any part of our services, you agree to comply with and be bound by these Terms. They apply to all users including browsers, property owners, seekers, and content contributors.
Important: By accessing and using 1stay.in, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
1. Description of Services
1stay.in is a property discovery marketplace that connects accommodation providers (“Owners”) with people seeking accommodation (“Seekers”). Our current services include:
- Property search and discovery
- Unlocking verified contact information of property owners (for Seekers)
- Unlocking property location details (for Seekers)
- Property listing and management tools (for Owners)
- Subscription plans for enhanced visibility and access
- Referral programme, coupon codes, and wallet balance system
- Customer support and assistance
Note on Bookings: 1stay.in is currently a search and contact platform. Direct booking and reservation management features are planned for a future release. All transactions between Seekers and Owners (if any) are conducted independently outside our Platform.
2. User Accounts and Registration
Account Creation
You must provide accurate, current, and complete information during registration and maintain its accuracy at all times. One account per person — multiple accounts to circumvent restrictions are prohibited.
Account Security
- You are responsible for maintaining the confidentiality of your credentials
- Notify us immediately of any unauthorized account access
- You are fully responsible for all activities conducted through your account
- We reserve the right to suspend or terminate accounts that violate these Terms
Eligibility
You must be at least 18 years old to create an account. By using the Platform you represent that you meet this requirement and have the legal capacity to enter into binding agreements.
3. Subscription Plans and Payments
Plans for Seekers
Seekers may purchase subscription plans to unlock property owner contact information and/or property location details. Each plan specifies the number of contacts and locations that can be unlocked within the plan period.
Plans for Owners
Owners may subscribe to plans to list properties on the Platform and receive enhanced visibility features. Plan details, including the number of listings permitted and additional features, are outlined at the time of purchase.
Payment Terms
- Payment is required at the time of plan purchase unless otherwise specified
- We use third-party payment services including PhonePe, UPI gateways, and banking partners such as Axis Bank
- All online payments are processed securely through our trusted payment gateway providers
- Subscription fees are non-refundable once the plan has been utilized (see Cancellation & Refund Policy)
Wallet Balance, Referral Bonus & Coupons
- Users may earn wallet balance through the referral programme — a bonus is credited when a referred user successfully signs up and completes their first plan purchase
- Coupon codes may be issued by 1stay.in as promotional discounts
- Wallet balance (including referral bonus) and coupon discounts can be applied towards the purchase of any subscription plan
- Wallet balance and referral bonus have no cash value and cannot be withdrawn
- Coupon codes are subject to individual terms, expiry dates, and minimum purchase requirements
- Unused wallet balance or referral bonus is forfeited if an account is terminated
4. Contact & Location Unlock — Seeker Responsibilities
- Unlocked contact information and property locations are for personal use only
- You must not share, resell, or distribute unlocked contact or location data to third parties
- You agree to contact property owners only for genuine accommodation enquiries
- Misuse of contact information (spam, harassment, or fraudulent enquiries) will result in account suspension
- Each contact or location unlock counts against your active plan's allowance
5. Property Listings — Owner Responsibilities
- All listing information (address, price, amenities, availability) must be accurate and kept up to date
- Uploaded media must be genuine photos/videos of the property — stock images are prohibited
- You must have the legal authority to rent or sub-let the property you list
- Contact details provided must be valid and reachable by genuine Seekers
- Listings must comply with applicable local municipal and government regulations
Prohibited Content
- Fake, duplicate, or misleading listings
- Properties used for or facilitating illegal activities
- Listings that discriminate on the basis of religion, caste, gender, or any protected characteristic
- Intentionally incorrect contact details or location information
6. User Conduct and Prohibited Activities
Prohibited Content
- Post false, misleading, or fraudulent information
- Upload content violating intellectual property rights
- Share inappropriate, offensive, or harmful content
- Post spam or unsolicited promotional material
Prohibited Behaviour
- Circumvent plan or payment systems
- Use automated tools to scrape or bulk-extract contact or location data from the Platform
- Interfere with the proper functioning of our services
- Impersonate other users or entities
- Abuse the referral programme through self-referrals or fraudulent accounts
- Violate applicable Indian or international laws
7. Intellectual Property
The Platform, including its design, code, trademarks, and brand assets, is owned by 1STAY TECHNOLOGY PRIVATE LIMITED. You must not copy, reproduce, or create derivative works without our prior written consent.
By uploading media or content to the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to display, store, and transmit that content solely for the purpose of operating and improving the Platform. You retain all ownership of your content.
8. Limitation of Liability and Disclaimers
Service Disclaimer
Our services are provided “as is” and “as available” without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any content on our platform.
Contact & Location Accuracy
While we make reasonable efforts to verify listed information, we do not guarantee the accuracy of owner contact details or property locations. Seekers should exercise due diligence before acting on any information obtained through the Platform.
Third-Party Interactions
1stay.in facilitates discovery and initial contact. Any negotiations, agreements, or transactions conducted between Seekers and Owners after contact is established are solely the responsibility of the respective parties. We are not liable for any outcomes of such independent interactions.
Limitation of Damages
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our services.
Force Majeure
Neither party shall be liable for any failure to perform due to unforeseen circumstances or causes beyond their reasonable control, including natural disasters, government actions, or other force majeure events.
9. Termination
Termination by You
You may terminate your account at any time by contacting our support team. Upon termination, unused wallet balance, referral bonus, and plan credits are forfeited. Active plan benefits remain accessible until the end of the current plan period.
Termination by Us
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, abuse the referral programme, or for any other reason at our sole discretion.
Effect of Termination
Upon termination, your right to use our services will cease immediately. Provisions that by their nature should survive termination — including ownership, warranty disclaimers, and limitations of liability — shall survive.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be Jharkhand, India.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the “Last updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
